Data subjects’ rights regarding SIS data

Everyone can request access, rectification and deletion of their personal data in the SIS

Each person has the right to access to the data relating to him/her recorded in the SIS and may request the rectification of inaccurate data and the deletion of unlawfully recorded data.

Please note: If the controller has reasonable doubt about the identity of the natural person making the request for access, he/she may request additional information necessary to confirm the identity of the data subject. If you are not sure that the SIRENE Bureau can clearly identify you, it is recommended to attach a copy of a photo ID to the information request.

However, information shall not be communicated to the data subject if this is indispensable for the performance of a lawful task in connection with an alert or for the protection of the rights and freedoms of third parties. With regard to the rights to rectification and deletion, the data subject shall be informed as soon as possible which measures were taken.

If the controller does not (fully) provide the relevant information within one month the applicant can lodge a complaint with the Austrian Data Protection Authority (Datenschutzbehörde) in accordance with § 24 DSG. This also applies where the controller has not (sufficiently) rectified or deleted the data. While complaint forms can be found on this website, the complaint must be filed in German. Claims for compensation are to be asserted in court.
